Terms and Conditions
I. Definitions
The terms used in these Terms and Conditions have the following meanings:
- Customer – a natural person, a legal entity, or an organizational unit that is not a legal entity but is granted legal capacity under specific provisions, which places an Order through the Store;
- Consumer – pursuant to Article 22(1) of the Civil Code, this term refers to a natural person who enters into a legal transaction with a business entity that is not directly related to their business or professional activities.
- Civil Code – Act of April 23, 1964 (Journal of Laws No. 16, Item 93, as amended);
- Terms and Conditions – these Terms and Conditions set forth the general terms of sale and the rules for the provision of electronic services through the online storehttps://key-soft.pl/;
- Online Store (Store) – the website available athttps://key-soft.pl/, through which the Customer may, in particular, place Orders;
- Products – items offered in the Online Store;
- Sales Agreement – an agreement for the sale of Goods as defined by the Civil Code, entered into between Key-Soft.pl and the Customer via the Store’s website;
- Consumer Rights Act – Act of May 30, 2014, on Consumer Rights (Journal of Laws of 2014, item 827);
- Act on the Provision of Electronic Services – the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended);
- Order – a declaration of intent by the Customer, aimed directly at concluding a Sales Agreement, specifying, in particular, the type and quantity of the Goods.
II. General Provisions
- These Terms and Conditions set forth the rules for using the online store available athttps://key-soft.pl.
- These Terms and Conditions are the terms and conditions referred to in Article 8 of the Act on the Provision of Electronic Services.
- These Terms and Conditions specify, in particular:
– rules for registering and using an account on the online store;
– Terms and conditions for placing orders electronically through the online store;
– Rules for entering into sales agreements using the services provided through the Online Store.
- You can use the online store provided that the IT system you are using meets the following minimum technical requirements: a web browser and Internet access
- To use the online store, the Customer must have access to a computer or other device with an Internet connection.
- In accordance with applicable law, Key-Soft.pl reserves the right to restrict the provision of services through the Online Store to individuals who are at least 18 years of age. In such cases, potential customers will be notified of this restriction.
- Customers may access these Terms and Conditions at any time via the link on the homepage of the websitehttps://key-soft.pl, and may download and print them.
III. Terms of Use for the Online Store
- Registration with the Online Store is optional. Customers may place an order without registering with the Store, provided they have read and accepted these Terms and Conditions.
Registration is completed by filling out and submitting the registration form available on one of the Store’s pages
To register, you must agree to the Terms and Conditions and provide the personal information marked as required.
Key-Soft.pl may revoke the Customer’s right to use the Online Store, as well as restrict the Customer’s access to some or all of the Online Store’s resources, with immediate effect, in the event that the Customer violates these Terms and Conditions, and in particular if the Customer:
– provided false, inaccurate, or outdated information during registration on the online store, or information that is misleading or infringes on the rights of third parties,
– has, through the online store, infringed upon the personal rights of third parties, in particular the personal rights of other customers of the online store,
– engages in other conduct that Key-Soft.pl deems to be in violation of applicable laws or general principles of Internet use, or that damages the reputation of Key-Soft.pl.
A person who has been barred from using the online store may not re-register without the prior consent of Key-Soft.pl
- To ensure the security of communications and data in connection with the services provided through the Website, the Online Store implements technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures designed to prevent unauthorized persons from obtaining or modifying personal data transmitted over the Internet.
- The customer is required, in particular, to:
– to use the Online Store in a manner consistent with the laws in force in the Republic of Poland, the provisions of these Terms and Conditions, and the general principles of Internet use.
– not to provide or transmit content prohibited by law, such as content that promotes violence, is defamatory, or infringes on the personal rights and other rights of third parties,
– using the Online Store in a manner that does not interfere with its operation, in particular by using specific software or devices,
– refraining from actions such as: sending or posting unsolicited commercial messages (spam) through the Online Store,
– to use the Online Store in a manner that does not inconvenience other customers or Key-Soft.pl,
– to use any content posted on the Online Store solely for your own personal use,
IV. Procedure for Entering into a Sales Agreement
- To enter into a Sales Agreement through the Online Store, visit the websitehttps://key-soft.pl and select the Product by following the on-screen instructions and using the information available on the website.
- The Customer selects the items to be ordered by adding them to the shopping cart.
- While placing an Order—until the button confirming the Order is clicked—the Customer may modify the information entered and the selected Product. To do so, please follow the on-screen prompts and the information provided on the website.
- Once the Customer using the Online Store has provided all the necessary information, a summary of the Order placed will be displayed. The summary of the Order placed will include, among other things, a description of the selected goods or services, the total price, and all other costs.
- To place an Order, you must accept the Terms and Conditions, provide the personal information marked as required, and click the button to confirm your Order.
- The information about the Products provided on the Store’s website constitutes an offer within the meaning of Article 66 of the Civil Code. Submission of an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with Key-Soft.pl, in accordance with the Terms and Conditions.
The Agreement is deemed concluded upon receipt of the Customer’s Order by the Online Store’s IT system, provided that the Order complies with the Terms and Conditions.
After the contract is concluded, the Customer receives an email containing confirmation of all essential elements of the Order. - The sales agreement is concluded in Polish, and its terms are consistent with the Terms and Conditions.
- Customers may access these Terms and Conditions at any time via the link on the homepage of the websitehttps://key-soft.pl, and may download and print them.
Order details and the General Terms and Conditions (Terms of Sale) are recorded, secured, and made available via email. You can view your previous orders in your account after logging in.
V. Delivery
- Delivery of the Goods is not limited to the territory of the Republic of Poland and is made to the address provided by the Customer when placing the Order.

Shipping costs are: 0 PLN. Additionally, shipping costs will be indicated when placing the Order.
- The delivery time is 24 hours, starting from the day the Customer places the Order.

VII. Right to Cancel a Distance Contract
The consumer hasthe right to cancel a distance contract within 14 days, provided they state a reason and confirm that the product has not been and will not be used—digital product.
The right to cancel the contract expires 14 days after the date the contract was concluded.
The right to cancel the contract does not apply to products delivered digitally—there is no obligation to return them.
To exercise your right to cancel the contract, you must notify us—Key-Soft.pl (email: bok@Key-Soft.pl)—of your decision to cancel the contract by means of an unambiguous statement (e.g., a letter sent by mail, fax, or email).
You may use the sample withdrawal form provided below, but this is not mandatory.
To meet the deadline for withdrawing from a distance contract, it is sufficient for you to send a notice regarding the exercise of your right to withdraw from the contract before the withdrawal period expires.

Consequences of withdrawing from the contract
If you withdraw from this contract, we will refund all payments received from you, including the cost of delivery (except for any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method we offer), immediately, and in any case no later than 14 days from the date on which we were informed of your decision to exercise your right to withdraw from this contract. We will refund your payment using the same payment methods you used in the original transaction, unless you have expressly agreed to a different solution; in any case, you will not incur any fees in connection with this refund.
Exceptions to the right of withdrawal
The Customer (consumer) does not have the right to cancel the contract in the case of the following contracts:
– where the subject of the transaction is audio or video recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery
– where the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or designed to meet the consumer’s specific needs
– for the supply of digital content not recorded on a tangible medium, if the performance of the service began with the consumer’s express consent before the expiration of the withdrawal period and after the trader informed the consumer of the loss of the right of withdrawal
– a contract in which the price or remuneration depends on fluctuations in the financial market over which the trader has no control and which may occur before the deadline for withdrawing from the contract
– a contract where the subject of the service is an item delivered in sealed packaging that cannot be returned once the packaging has been opened for health or hygiene reasons, if the packaging was opened after delivery
– a contract in which the subject matter of the performance consists of items that, upon delivery, become inseparably integrated with other items due to their nature
– a contract concluded at a public auction
VIII. Complaints Regarding Goods
Applies to Customers who are Consumers:
We are obligated to deliver goods free from defects. The statutory liability for defects in sold goods (warranty for defects) applies to the extent specified in Articles 556 and 556[1]–556[3] et seq. of the Civil Code.

If you exercise your rights under the warranty—provided we deem it necessary to process your claim—you are required to ship the defective goods to the mailing address listed above at our expense. If, due to the nature of the goods or the manner in which they were installed, delivery of the goods would be unduly difficult, you are required to make them available to us at the location where they are currently situated. We undertake to respond to the complaint without delay, no later than within 14 days of the date it was submitted.
We are liable under the warranty if a physical defect is discovered within two years of the date the goods were delivered to you. If the item sold is a used movable item, the warranty period is one year from the date of delivery.
When filing a complaint, it is recommended that you (1) provide information regarding the subject of the complaint, specifically the nature and date of the defect; (2) specify your request regarding how the defect should be remedied (replacement of the item with a new one, repair of the item, price reduction, or cancellation of the contract—provided the defect is significant); and (3) provide the contact details of the person filing the complaint—this will facilitate and expedite the Store’s processing of the complaint. The recommendations set forth in the preceding sentence are merely non-binding guidelines and in no way affect the validity of complaints filed without providing the recommended information.
Applies to a Customer who is not also a Consumer:
In the case of a Sales Agreement concluded with a Customer who is not a Consumer, pursuant to Article 558 § 1 of the Civil Code, the Online Store’s liability under the warranty for defects in the Goods is excluded. This exclusion does not apply if we have fraudulently concealed a defect
IX. Additional Warranties for the Sale of Goods in the Store
Key-Soft.pl is not the manufacturer of the Products; however, all Products available in the Store are additionally covered by a warranty from Key-Soft.pl as the seller. Key-Soft.pl is liable under the warranty for the sold Product in accordance with the terms and for the period specified in the warranty card included with the Product.
The manufacturer may be independently liable under the warranty for the Goods sold, subject to the terms and for the period specified in the warranty card issued by the manufacturer. If the manufacturer’s warranty document provides for this option, the Customer may also file warranty claims directly with an authorized service center, whose address is listed in the warranty card.
All Products available in the Store are covered by Key-Soft.pl’s liability under the statutory provisions regarding the warranty for defects. This warranty does not exclude, limit, or suspend the Customer’s rights under the provisions regarding the warranty for defects in the sold item.
X. Complaints Regarding the Provision of Electronic Services
- Key-Soft.pl takes steps to ensure the proper functioning of the Online Store, to the extent permitted by current technical knowledge, and undertakes to resolve any issues reported by customers within a reasonable timeframe.
- Customers may notify us of any malfunctions or disruptions in the operation of the Online Store. Please report any issues related to the operation of the Store via email to: BOK@Key-Soft.pl
- When filing a complaint regarding issues with the operation of the online store, please specify the nature of the issue and the date it occurred.
- We undertake to respond to complaints promptly, no later than 14 days from the date they are submitted.
XI. Out-of-court methods for handling complaints and pursuing claims
- Please be advised that there are options for resolving complaints and pursuing claims through out-of-court dispute resolution. The use of these options is voluntary and may only take place if both parties to the dispute agree to it.
– The consumer may submit a request to initiate proceedings for the out-of-court resolution of consumer disputes concerning the concluded Sales Agreement to the Trade Inspection Authority, in accordance with Article 36 of the Act of December 15, 2000, on the Trade Inspection Authority (Journal of Laws 2001 No. 4, item 25, as amended).
– The consumer may also file a request for the resolution of a dispute concerning the concluded Sales Agreement with the permanent arbitration court operating at the relevant provincial office of the Trade Inspection, in accordance with Article 37 of the Act of December 15, 2000, on the Trade Inspection (Journal of Laws 2001 No. 4, item 25, as amended).

It is available at:http://ec.europa.eu/consumers/odr/. - Detailed information regarding the resolution of consumer disputes, including the Consumer’s options for using out-of-court complaint handling and dispute resolution procedures, as well as the rules governing access to these procedures, is available at the offices and on the websites of the provincial inspectorates of the Trade Inspection Authority, as well as at the following web address:https://uokik.gov.pl/spory_konsumenckie.php.
XII. Final Provisions
- The court with jurisdiction to hear disputes with consumers is the court with local jurisdiction under the applicable provisions of the Code of Civil Procedure.
- Any disputes arising between Key-Soft.pl and a Customer who is not a Consumer shall be resolved by the court having jurisdiction over our registered office.
- In matters not covered by these Terms and Conditions, the provisions of applicable law shall apply, in particular the provisions of the Act of April 23, 1964—Civil Code (consolidated text: Journal of Laws of 2014, item 121, as amended) and the Act of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827). In the event of any conflict between these Terms and Conditions and the rights of Customers or provisions arising from generally applicable laws, the generally applicable provisions of Polish law shall apply.
